Terms of Use

These Terms of Use (“terms”) apply to your use of OzPlayHub at ozplayhub.com (the “site”), including your account and the games. Please read them carefully. Our Privacy Policy and Cookie Policy explain how we handle personal data and cookies.

1. Who we are

2. Accepting these terms

By using the site or creating an account, you agree to these terms. If you do not agree, please do not use the site. These terms form a legally binding agreement between you and CTI DIGITAL LIMITED. When you sign up, you confirm that you are 13 or older and that you accept these terms - by ticking a box, or, if you sign up with Google, by continuing after the notice next to the Google button.

3. The service

OzPlayHub offers free casual games that you play in your web browser, for entertainment only.

• Anyone can read our public pages. To play the games, you need a free account.
• The service is free. We never charge you, and there is nothing to buy from us - no subscriptions, purchases or paid upgrades.
• The games run in your browser, so there is nothing to download or install. You are responsible for your own device and internet connection.

4. Free to play - no gambling

OzPlayHub is not a gambling service. To be completely clear:

• There is no real-money gambling, betting or wagering of any kind.
• You cannot pay or deposit money. There are no purchases, in-game payments or paid upgrades.
• There are no cash prizes, material prizes, vouchers or other rewards to win.
• Scores, levels and achievements are just for fun. They have no monetary value and cannot be sold, exchanged, transferred or redeemed for money, goods or anything else.

If anyone offers you money, prizes or rewards in connection with OzPlayHub, the offer did not come from us - please report it to support@ozplayhub.com.

5. Who can use the site

You must be at least 13 years old to create an account or play the games, and by signing up you confirm that you are. If you are under 18, you should have permission from a parent or guardian, and we recommend that they read these terms with you. If we learn that an account belongs to a child under 13, we will delete it.

6. Your account

• Accurate details. Give accurate information when you sign up and use an email address that you control - we use it for password resets and security notices.
• One person, one account. Your account is for you alone. Do not share it or let anyone else use it, and do not sell or transfer it.
• Keep your password safe. Choose a strong password that you don't use anywhere else and keep it secret. If you think someone else has used your account, change your password and tell us straight away at support@ozplayhub.com.
• Suitable usernames. Choose a username that is not offensive and does not impersonate anyone else, including us.
• Forgotten your password? Use “Forgot password?” on the log-in page. We will email you a single-use reset link that expires after 60 minutes.
• Leaving. You can delete your account at any time on the Your account page. Deletion is immediate and permanent.

We may suspend or close your account if you seriously or repeatedly break these terms, if the law requires it, or if it is necessary to protect other users or the site. Where appropriate, we will tell you why.

7. Acceptable use

You must not:

• use bots, scripts, scrapers or other automated means to access the site, create accounts or play games;
• scrape, copy, harvest or redistribute our content, the game catalogue or links to the games;
• bypass or try to bypass log-ins, rate limits or other access controls, or use another person's account;
• probe, scan or test the security of the site, or interfere with or disrupt it - for example by overloading it or introducing malware;
• reverse engineer, decompile or modify the site or the games, except where the law allows it;
• create several accounts to get around limits, suspensions or bans;
• impersonate any person or organisation, including us, or misrepresent your connection with them;
• use the site for anything unlawful, fraudulent, harassing, abusive or harmful, including in messages you send us;
• advertise, describe or present OzPlayHub as offering money, prizes, winnings or gambling, or misrepresent what it offers in any other way.

8. Games from a third-party publisher

The games are created and hosted by a third-party publisher, HTMLGames.com, and load from its servers inside a frame on our play page.

• The publisher's own terms and policies, including its privacy policy, apply to the games.
• The publisher may show its own adverts inside the games. We do not control those adverts.
• Games may change, stop working or be removed at any time, and the selection on the site may change without notice.
• We choose games that we consider suitable for players aged 13 and over, but the publisher controls their content. If you see anything inappropriate in a game or an advert, please tell us and we will review it.

9. Advertising

OzPlayHub is free. Games may contain adverts from their publisher, and in future we may show adverts on our own pages. Any adverts we place will be clearly labelled as advertising and will never be disguised as game content, download buttons or links. Advertisers are responsible for their adverts and for the products and services they offer. We do not endorse them and are not responsible for them, and any dealings you have with an advertiser are between you and the advertiser.

10. Intellectual property

• The site - including its design, text, graphics, and the OzPlayHub name and logo - belongs to us or our licensors and is protected by intellectual property laws.
• Games, game names, images and trade marks belong to their respective owners. The games are embedded under the publisher's terms.
• You may use the site for your own personal, non-commercial entertainment. Apart from that, you may not copy, reproduce, republish, frame or commercially use any part of it without our written permission, except where the law allows it.

Copyright complaints

If you believe that something on the site infringes your copyright or other rights, email support@ozplayhub.com with: the work you believe is being infringed; the content you are complaining about and where it appears on the site; your contact details; and a statement that your complaint is accurate and that you own the rights or are authorised to act for the owner. We will act promptly, which may include removing or disabling the content.

11. Availability and changes to the service

We work to keep the site running smoothly, but because it is a free service we cannot promise that the site, or any particular game, will always be available, uninterrupted or free of errors. We may change, suspend or withdraw the site, any game or any feature at any time - for example, for maintenance, security, legal or business reasons. If we decide to close the site permanently, we will try to give reasonable notice on the site.

12. Privacy

Our Privacy Policy explains how we collect and use personal data, and our Cookie Policy explains how we use cookies and how you can control them. You can delete your account and its data at any time on the Your account page.

13. Disclaimers

The site and the games are provided free of charge, “as is” and “as available”. Except as set out in these terms, and to the extent the law allows, we do not make any promises about the site or the games - for example, that they will meet your needs, work on every device or browser, or be free of errors. Nothing in these terms affects your statutory rights as a consumer.

14. Limitation of liability

• Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be excluded or limited by law.
• Subject to that, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable, for indirect or consequential loss, or for events outside our reasonable control.
• The site is for domestic and private use only, so we are not liable to you for any loss of profit, loss of business, business interruption or loss of business opportunity.
• Because the site is provided free of charge, our total liability to you for all claims arising out of or in connection with the site or these terms is limited to £50 (fifty pounds sterling).

15. Ending these terms

You can stop using the site at any time and delete your account on the Your account page. We may suspend or end your access as described in section 6, or if we stop providing the site. When these terms end, the parts that are meant to continue - including intellectual property, limitation of liability and governing law - still apply.

16. Changes to these terms

We may update these terms from time to time - for example, to reflect changes in the law or in the site. We will publish the updated terms on this page and change the “Last updated” date at the top. If a change is significant, we will highlight it on the site before it takes effect. If you keep using the site after the changes take effect, the updated terms apply; if you do not agree with them, you can stop using the site and delete your account.

17. Governing law and disputes

If you have a complaint, please contact us first - most problems can be solved quickly.

These terms are governed by the law of England and Wales, and you can bring legal proceedings in the courts of England and Wales. If you are a consumer living in Scotland or Northern Ireland, you can also bring proceedings in your local courts. If you live outside the United Kingdom, you keep the protection of the mandatory consumer laws of the country where you live, and nothing in these terms takes that away.

18. General

• Severability. If a court decides that any part of these terms is invalid or unenforceable, the rest of the terms continue to apply.
• No waiver. If we delay or do not enforce any part of these terms, we can still enforce it later.
• Entire agreement. These terms, together with our Privacy Policy and Cookie Policy, are the entire agreement between you and us about your use of the site.
• Transfer. We may transfer our rights and obligations under these terms to another organisation, for example if the site is sold. This will not affect your rights under these terms. You may not transfer your account or your rights under these terms to anyone else.
• Third-party rights. No one other than you and us has any right to enforce these terms.
